Trepai Terms & Conditions

1. What Trepai Is

Trepai is a hotspot discovery platform. We help users discover curated hotspots such as pop-up stores, cafes, restaurants, events, third spaces, running clubs, padel spots, urban culture locations, and other experiences.

Trepai currently focuses on curated discovery and in-app route functionality. In the future, Trepai may include social features, creator profiles, brand profiles, comments, messaging, recommendations, premium features, paid promotions, affiliate links, and other interactive tools.

Trepai is not the owner, operator, organizer, or provider of the third-party hotspots listed in the Service unless expressly stated otherwise.

2. Eligibility

You must be at least 16 years old to use Trepai.

By using the Service, you confirm that:

1. you are at least 16 years old;
2. you have the legal capacity to enter into these Terms;
3. the information you provide is accurate and up to date;
4. you will use the Service only in accordance with these Terms and applicable law.

If we become aware that a user is under 16, we may suspend or delete the account.

3. Account Registration

To use the Trepai app, you need to create an account.

Currently, account registration is available through Sign in with Apple. Trepai is currently available through the Apple App Store for iOS devices.

You are responsible for keeping your account secure and for all activity that happens under your account. You must not share your account, impersonate another person, or create an account using false information.

We may suspend, restrict, or terminate your account if we believe you have violated these Terms, used the Service abusively, created risk for Trepai or other users, or acted unlawfully.

4. Waitlist

Trepai may offer a waitlist before or alongside app access.

When joining the waitlist, you may be asked to provide your email address and other optional information. Joining the waitlist does not guarantee access to the app, early access, creator access, brand access, invitations, or any specific feature.

We may approve, reject, delay, or prioritize access at our own discretion.

5. Hotspot Information

Trepai provides information about hotspots, including but not limited to names, descriptions, categories, locations, opening hours, availability, routes, dates, pricing indications, images, recommendations, and other related details.

Although we aim to keep hotspot information useful and accurate, we do not guarantee that any hotspot information is complete, accurate, current, or error-free.

Hotspot details may change at any time. This includes:

1. opening hours;
2. event dates;
3. availability;
4. access rules;
5. prices;
6. queue times;
7. capacity;
8. location details;
9. safety conditions;
10. whether a hotspot is still active or available.

Before visiting a hotspot, you should verify important information directly with the hotspot, venue, organizer, brand, or another official source.

6. Curated Content

Currently, hotspots are created, edited, and managed by the Trepai team.

Trepai has full discretion over:

1. which hotspots are added;
2. how hotspots are categorized;
3. how hotspots are described;
4. how hotspots are ranked or displayed;
5. whether a hotspot is edited or removed;
6. whether certain hotspots are highlighted, recommended, or featured.

A hotspot being listed on Trepai does not mean that Trepai endorses, guarantees, owns, operates, or is responsible for that hotspot.

7. Routes and Location-Based Features

Trepai may use your device location, if you grant permission, to show nearby hotspots or provide in-app route functionality.

Currently, Trepai does not collect user location data for long-term profiling unless separately disclosed in our Privacy Policy and permitted by applicable law. However, the app may use location access on your device to enable features such as nearby hotspot discovery or route planning.

In the future, Trepai may offer additional location-based features, including personalized recommendations, social discovery, nearby users, heatmaps, density indicators, and other interactive location-based experiences. If such features involve the collection or processing of personal location data, they will be described in our Privacy Policy and may require additional permissions or settings.

You can control location permissions through your iOS device settings.

Trepai does not guarantee the accuracy, safety, legality, availability, or suitability of any route, direction, travel time, distance, or navigation-related information. Always follow local laws, traffic rules, venue rules, and your own judgment.

8. No Responsibility for Hotspot Experiences

Trepai is a discovery and information platform. We are not responsible for what happens at third-party hotspots.

To the fullest extent permitted by law, Trepai is not liable for:

1. bad experiences at hotspots;
2. injuries, accidents, illness, loss, or damages;
3. unsafe locations or events;
4. cancelled, closed, delayed, or overcrowded hotspots;
5. poor service by third parties;
6. disputes with venues, brands, organizers, creators, restaurants, cafes, clubs, stores, or other third parties;
7. inaccurate information provided by third parties;
8. user decisions made based on hotspot information.

You visit hotspots at your own risk.

9. Third-Party Services

Trepai may display, link to, recommend, or integrate third-party services, including maps, venues, restaurants, brands, booking platforms, transport providers, event organizers, creators, payment providers, social platforms, and affiliate partners.

Third-party services are not controlled by Trepai. Your use of third-party services may be subject to their own terms, privacy policies, prices, rules, and conditions.

Trepai is not responsible for third-party services, content, availability, pricing, decisions, actions, failures, or damages.

10. Future Creator and Brand Features

Trepai may later allow creators, influencers, brands, venues, agencies, or other partners to create profiles, showcase hotspots, submit content, promote hotspots, collaborate with Trepai, or access business tools.

If these features are launched, Trepai may set additional terms, commercial conditions, approval processes, content rules, visibility rules, and verification requirements.

Trepai reserves the right to:

1. approve or reject creators and brands;
2. remove creator or brand content;
3. edit or moderate submitted content;
4. control how content appears in the app;
5. rank, recommend, hide, label, or feature content;
6. distinguish between organic and paid visibility where required;
7. suspend or terminate creator or brand access.

No creator, brand, or partner has a guaranteed right to visibility, ranking, reach, traffic, engagement, conversions, or revenue.

11. Paid Promotions and Featured Hotspots

Trepai may later offer paid promotions, branded hotspots, sponsored placements, featured categories, map placements, geo-triggered promotions, affiliate integrations, or other commercial visibility products.

Paid or sponsored content may influence how certain hotspots appear in the Service. Where required by law or platform rules, Trepai will label paid or sponsored placements appropriately.

Trepai does not guarantee performance, reach, visits, conversions, sales, or any specific commercial outcome from paid promotions unless separately agreed in writing.

12. Premium Features, Subscriptions, and In-App Purchases

Trepai may later offer premium features, subscriptions, in-app purchases, digital perks, memberships, creator features, brand tools, or other paid services.

If paid features are introduced, additional payment terms may apply.

Where purchases are made through the Apple App Store, Apple's payment terms and policies may apply. Prices, billing cycles, refunds, cancellation rights, trial periods, and renewal conditions will be shown before purchase where required.

Trepai may change, add, remove, or discontinue paid features, subject to applicable law.

13. Affiliate Links

Trepai may later include affiliate links or commercial partnerships with third-party providers such as transport, booking, ticketing, travel, retail, or experience platforms.

If you click an affiliate link or use a partner offer, Trepai may receive a commission or other benefit. This does not necessarily increase the price you pay, but this may depend on the partner.

Trepai is not responsible for the third-party product, booking, service, availability, pricing, refund policy, or customer support.

14. User Content - Future Features

Currently, users cannot upload content, create hotspots, post comments, write reviews, or message other users inside Trepai.

However, Trepai may introduce user-generated content features in the future, including reviews, comments, hotspot suggestions, messages, lists, reactions, posts, discussions, or community areas.

If user content features become available, you will be responsible for the content you submit.

You must not upload, post, send, or share content that:

1. is illegal, harmful, threatening, abusive, harassing, hateful, discriminatory, violent, or defamatory;
2. contains sexually explicit, exploitative, or otherwise inappropriate material;
3. promotes self-harm, violence, terrorism, or illegal activity;
4. violates another person's privacy, image rights, intellectual property, or other rights;
5. contains spam, scams, misleading information, malware, or unauthorized advertising;
6. impersonates another person, brand, creator, or organization;
7. manipulates reviews, rankings, hotspot visibility, or engagement;
8. disrupts the Service or other users.

Trepai has zero tolerance for objectionable content and abusive users.

We may remove content, restrict features, suspend accounts, report users, or take other action at our discretion.

15. License to User Content

If Trepai allows you to submit content in the future, you remain the owner of your content, but you grant Trepai a worldwide, non-exclusive, royalty-free, transferable, sublicensable license to use, host, store, reproduce, edit, translate, display, distribute, promote, and otherwise process your content for the purpose of operating, improving, marketing, and providing the Service.

This license allows Trepai to display your content in the app, on maps, in feeds, in hotspot pages, in creator profiles, in brand collaborations, in marketing materials, and across related Trepai channels.

You confirm that you have all rights necessary to grant this license.

16. Community and Social Features

Trepai may later include social features such as comments, direct messages, discussions, groups, following, friend discovery, creator pages, or location-based connection tools.

You agree to use social features respectfully and lawfully.

You must not:

1. harass, threaten, stalk, bully, or abuse other users;
2. send spam or unwanted promotions;
3. collect user information without permission;
4. share private information about others;
5. misuse location-based features;
6. create fake accounts or manipulate social interactions;
7. use Trepai to organize illegal, unsafe, or harmful activity.

We may moderate social features but are not obligated to monitor all activity.

17. Acceptable Use

You agree not to:

1. use Trepai for illegal purposes;
2. violate any applicable laws or regulations;
3. interfere with or disrupt the Service;
4. reverse engineer, copy, scrape, or misuse Trepai's technology;
5. access Trepai using unauthorized bots, scripts, crawlers, or automated tools;
6. attempt to bypass security or access restrictions;
7. use Trepai to compete with us by copying our data, design, content, or hotspot database;
8. misuse maps, routes, recommendations, or hotspot information;
9. damage Trepai's reputation, systems, users, partners, creators, or brands.

We reserve the right to restrict or terminate access if we believe you have violated these rules.

18. Intellectual Property

Trepai, including its name, logo, app design, interface, hotspot database, curated descriptions, maps, categories, software, features, ranking systems, brand assets, and original content, is owned by or licensed to Fatih Sahmil Ayazoglu e.U.

You may not copy, reproduce, modify, distribute, sell, license, scrape, reverse engineer, or commercially exploit any part of Trepai without our prior written permission.

You are granted a limited, personal, non-exclusive, non-transferable, revocable license to use Trepai for its intended purpose.

19. Feedback and Suggestions

If you send us feedback, ideas, suggestions, feature requests, designs, or other input, you allow Trepai to use them without restriction or compensation.

This helps us improve the Service, but it does not create any ownership, payment, employment, partnership, or confidentiality obligation unless separately agreed in writing.

20. Availability and Changes to the Service

Trepai is evolving. Features may be added, changed, limited, paused, or removed at any time.

We do not guarantee that the Service will always be available, uninterrupted, secure, error-free, or compatible with every device or iOS version.

We may update the app, change hotspot categories, modify recommendations, test beta features, limit access, or discontinue parts of the Service.

Some features may be experimental or in beta, including route-related features. Beta features may be incomplete, inaccurate, unstable, or changed without notice.

21. App Store Terms

Trepai is currently distributed through the Apple App Store.

Your download and use of the app may also be subject to Apple's terms, policies, and rules. Apple is not responsible for Trepai's content, hotspot information, support, or services, except as required under Apple's own terms.

If there is a conflict between these Terms and mandatory Apple App Store rules, Apple's applicable rules may apply to the relevant app store process.

22. Privacy

Your privacy is important to us.

Our collection and use of personal data is described in our Privacy Policy. The Privacy Policy is separate from these Terms and should be read together with them.

The Privacy Policy should explain, where applicable:

1. what data we collect;
2. how we use data;
3. how Sign in with Apple works;
4. how waitlist data is processed;
5. how location permissions work;
6. how future recommendation and social features may use data;
7. how users can exercise GDPR rights.

Using Trepai means you also acknowledge our Privacy Policy.

23. No Professional Advice

Trepai may provide recommendations, routes, hotspot descriptions, rankings, or suggestions.

These are provided for general discovery and convenience only. Trepai does not provide legal, safety, travel, medical, financial, or professional advice.

You are responsible for your own decisions.

24. Limitation of Liability

To the fullest extent permitted by applicable law, Trepai and Fatih Sahmil Ayazoglu e.U. are not liable for indirect, incidental, special, consequential, punitive, or lost-profit damages arising from or related to your use of the Service.

This includes damages related to:

1. hotspot visits;
2. inaccurate hotspot information;
3. third-party services;
4. route or location errors;
5. app downtime;
6. lost data;
7. account restrictions;
8. content removal;
9. failed recommendations;
10. cancelled events or unavailable venues.

Nothing in these Terms excludes liability where exclusion is not permitted by law, including liability for intentional misconduct or other mandatory statutory liability.

25. Indemnity

To the extent permitted by law, you agree to indemnify and hold harmless Fatih Sahmil Ayazoglu e.U. from claims, damages, losses, liabilities, costs, and expenses arising from:

1. your use of the Service;
2. your violation of these Terms;
3. your violation of law;
4. your future user content;
5. your misuse of social, creator, brand, or location-based features;
6. your infringement of third-party rights.

26. Termination

You may stop using Trepai at any time.

We may suspend, restrict, or terminate your access to Trepai at any time if:

1. you violate these Terms;
2. you misuse the Service;
3. we are required to do so by law;
4. your activity creates risk for Trepai, users, creators, brands, or third parties;
5. we discontinue the Service or part of it.

After termination, your right to use the Service ends immediately. Certain clauses will continue to apply, including intellectual property, liability, indemnity, and dispute-related clauses.

27. Changes to These Terms

We may update these Terms from time to time.

If we make material changes, we may notify you through the app, website, email, or another reasonable method.

The updated Terms will apply from the date stated at the top of the document or from another date communicated to you.

If you continue using Trepai after changes become effective, you accept the updated Terms.

28. Governing Law

These Terms are governed by the laws of Austria, excluding conflict-of-law rules.

If you are a consumer, you may also have mandatory rights under the laws of your country of residence that cannot be excluded by contract.

29. Dispute Resolution and Jurisdiction

If a dispute arises, we encourage you to contact us first so we can try to resolve it informally.

Where legally permitted, the competent courts in Vienna, Austria, shall have jurisdiction.

If you are a consumer, mandatory consumer protection rules may give you the right to bring claims in another competent court.
